Terms of Service

1. Eligibility

You must be at least 13 years of age to use BanishSubs. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you meet these age requirements.

2. Description of the Service

BanishSubs is a privacy-first subscription tracking and optimization application. The App helps you manually track recurring subscriptions, view estimated monthly and yearly spend, receive renewal reminders, and review rule-based suggestions intended to help you reduce or avoid unwanted subscription costs.

• Manually add and manage subscriptions, including provider name, cost, billing cycle, category, status, and renewal date
• View dashboards, renewal calendars, and local summaries of subscription spending
• Schedule local renewal reminders on your device
• Review rule-based optimization suggestions such as renewal reminders, high-cost subscriptions, duplicate categories, trial endings, or potential downgrade/cancel actions
• Use optional backup, export, or restore features where available, subject to the plan limitations displayed in the App

3. Local-First Operation and No User Account

BanishSubs does not require you to create a user account. There is no sign-up, login, password, or cloud authentication controlled by Lumivera Solutions Inc.

Subscription records that you enter in the App are stored locally on your device. We do not operate a cloud database that stores your subscription list, provider names, renewal dates, entered costs, categories, or notes. We cannot view, retrieve, edit, or restore your locally stored subscription records.

4. Free and Premium Features

BanishSubs may offer a free tier and optional premium features, including a Lifetime Pro purchase or similar paid entitlement. The exact features, limitations, pricing, and availability may vary by country, platform, app version, and promotional period and will be shown in the App or by the applicable app store before purchase.

Premium features may include expanded subscription tracking limits, full optimization access, additional actions, backup or restore functionality, or other features described in the App. We may update, modify, add, or discontinue features over time, provided that any material changes are made in accordance with applicable law and app store rules.

5. In-App Purchases, Billing, and Refunds

All in-app purchases are processed by Apple through the App Store or by Google through Google Play. Lumivera Solutions Inc. does not directly collect, process, or store your payment card, banking, or billing credentials.

The App may use a third-party purchase management service, currently RevenueCat, to validate purchases, manage entitlements, and enable purchase restoration across supported devices and platforms. This purchase-related processing is limited to information necessary to confirm whether premium access is active.

Prices are displayed at the point of purchase and may be shown in your local currency. Taxes, currency conversion, price adjustments, promotional pricing, and app store fees are managed by Apple, Google, or their payment partners.

Refunds, chargebacks, cancellations, and billing disputes are governed by the applicable App Store or Google Play policies. Please contact Apple or Google directly for refund requests unless the app store directs you to contact us.

6. Acceptable Use

You agree to use the App only for lawful, personal, and non-commercial purposes. You agree not to:

• Reverse-engineer, decompile, disassemble, modify, or attempt to derive the source code of the App except where permitted by law
• Copy, reproduce, distribute, resell, sublicense, or commercially exploit the App or any part of it
• Remove, obscure, or alter proprietary notices, branding, or legal notices in the App
• Use the App in a way that violates applicable law, third-party rights, platform rules, or these Terms
• Attempt to interfere with app store billing, entitlement checks, purchase restoration, or any security-related feature

7. Recommendations Disclaimer

Recommendations, estimated savings, renewal alerts, and category insights generated by BanishSubs are based on rule-based logic applied to information you manually enter. They are provided for general informational and personal budgeting purposes only.

BanishSubs does not provide financial, legal, tax, accounting, investment, or professional advice. You are responsible for reviewing the actual terms, cancellation rules, renewal dates, trial periods, contracts, and billing arrangements for each subscription provider before taking action. Lumivera Solutions Inc. is not responsible for any fees, lost access, missed renewals, cancellation issues, or financial outcomes resulting from your use of the App or reliance on its recommendations.

8. Notifications

If you grant notification permission, the App may schedule reminders on your device based on subscription renewal information you entered. You can enable or disable notifications through the App, where available, or through your device settings. Notification behavior may depend on operating system settings, battery settings, time zones, and device permissions.

9. Backups, Exports, Restores, and Data Loss

Because your subscription records are stored locally, you are responsible for maintaining backups where backup or export features are available. Backup or export files created by you are under your control and may contain subscription information you entered.

Your data may be lost if you uninstall the App, clear app data, reset your device, lose or damage your device, switch devices without restoring data, or delete backup/export files. Lumivera Solutions Inc. cannot recover locally stored data that is not backed up by you or your device system.

10. Third-Party Services, Names, and Logos

The App may display names, logos, icons, or references to third-party subscription providers to help you identify and categorize subscriptions. These third-party names and logos belong to their respective owners. Unless expressly stated, Lumivera Solutions Inc. is not affiliated with, sponsored by, or endorsed by those providers.

The App may also depend on Apple, Google, RevenueCat, Expo, operating system services, or similar infrastructure providers for app distribution, purchases, entitlement validation, notifications, and platform functionality.

11. Intellectual Property

The App, including its software, interface, design, text, branding, logos, and related materials, is owned by Lumivera Solutions Inc. or its licensors and is protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control for personal, non-commercial purposes. No other rights are granted.

12. Availability and Updates

We may update, improve, suspend, or discontinue the App or specific features from time to time. Some features may require a supported device, operating system, app store availability, internet connectivity for purchase validation, or other platform services. We do not guarantee uninterrupted, error-free, or permanently available operation.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the App is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

14. Limitation of Liability

BanishSubs is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Lumivera Solutions Inc. is not responsible for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost data, missed reminders, unexpected subscription charges, device damage, financial loss, or other losses arising from or related to your use of, or inability to use, the App.

If you have a claim against us, our total liability will not exceed the greater of: (a) the amount you paid for the App in the twelve (12) months before the event giving rise to the claim; or (b) CAD $50.00, unless a higher amount is required by applicable law in your jurisdiction.

Nothing in these Terms limits or excludes our liability for gross negligence, fraud, willful misconduct, or any liability that cannot be limited or excluded under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Lumivera Solutions Inc. and its affiliates, officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising from your misuse of the App, violation of these Terms, violation of law, or infringement of third-party rights.

16. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access to the App or premium features if required by law, app store rules, security concerns, or your material breach of these Terms. Sections intended to survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute provisions, will continue to apply.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the Effective Date and may provide notice in the App or on our website. Your continued use of the App after the updated Terms become effective means you accept the updated Terms. If you do not agree, you should stop using and uninstall the App.

18. Governing Law and Disputes

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law rules. Subject to any mandatory consumer protection rights that cannot be waived, disputes relating to these Terms or the App will be handled by the courts located in Calgary, Alberta, Canada.

19. Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect and the invalid provision will be modified to the minimum extent necessary to make it enforceable. These Terms, together with the Privacy Policy and any purchase terms shown by Apple or Google, form the agreement between you and Lumivera Solutions Inc. regarding the App.
